Investor Green Card

 

Investor Green Cards are issued in accordance with meeting the EB-5 eligibilty requirements. Qualified applicants for this card are foreign nationals who have invested, or are in the process of investing a required amount of money in a new commercial venture established by them. These applicants must also show proof that their investments will benefit the economy of the U.S. as well as create a certain number of full time jobs for qualified U.S. residents. The Green Card status for investors also includes their spouses and unmarried children.

In order to file the EB-5 Green Card petition, you must file Form I-526. This is called the Immigrant Petition by Alien Entrepreneur, and must include all supporting documentation at the time of filing. These documents must show that you are establishing a new commercial enterprise, investing the required amount of money, providing proof that the investment originates from a legal source of money, as well as creating the required number of jobs. You must also provide proof that you are actively participating in this business, and that you will create jobs within a certain area.

You can begin the process of obtaining a Conditional Resident status after you file the EB-5 Green Card petition by filing Form I-485. This is the application to Register Permanent Residence. If you wish to become a permanent resident as an immigrant investor, you will need to file Form I-829. This is a Petition by Entrepreneur to Remove Conditions. This form must be completed and filed within 90 days prior to the 2nd anniversary of your admission to the United States as a conditional resident.

If you wish to acquire an EB-5 Green Card, or Green Card for investors, you need to file Form I-526 at the USCIS Service Center that has jurisdiction over the area you will be locating your new commercial venture, or the area where it will be primarily conducting business.

There are 10,000 immigrant visas available annually to people who are qualified to seek permanent resident status based on their qualifications for starting a new commercial business.
